DSB was successful in moving for summary judgment on behalf of a school district located on Long Island. Plaintiff tripped and fell due to an alleged defect in the sidewalk abutting the school building. The Supreme Court, Suffolk County, held that DSB affirmatively demonstrated that the alleged condition was trivial and non-actionable as a matter of law. Accordingly, DSB’s motion for summary judgment was granted in its entirety.
