Theodore D. Sklar - Counsel

Theodore D. SklarMr. Sklar's legal career encompasses thirty-four years of experience as a civil litigator in the public and private sectors. His practice is wide ranging, emphasizing commercial and municipal litigation. He has litigated a broad spectrum of cases at the trial and appellate levels in the state and federal courts, ranging from C.P.L.R. Article 78 proceedings seeking judicial review of governmental determinations to commercial disputes between shareholders of a corporation. He has prepared and argued appeals before the New York State Court of Appeals, the United States Court of Appeals for the Second Circuit and the Supreme Court of the State of New York, Appellate Division, Second Judicial Department. For example, Ted successfully argued appeals in both the Appellate Division and in the New York State Court of Appeals that sought to hold a shareholder of a corporation personally liable for the corporation's purported breach of contract. That case, East Hampton Union Free School District v. Sandpebble Builders, Inc., is now one of the leading cases in the State of New York on the doctrine of "piercing the corporate veil."

Ted brings to the firm extensive experience in land use litigation. He has represented clients before municipal zoning and planning boards and he has litigated special proceedings and declaratory judgment actions to overturn or to sustain decisions by those administrative boards. He obtained a judicial determination that a planning board's rejection of a site plan application for a bank was arbitrary and capricious, and he also succeeded in obtaining a certificate of occupancy for an ice skating rink despite the refusal of both the Building Inspector and the Zoning Board of Appeals to approve the certificate.

Ted has also represented businesses and individuals in a variety of litigated matters, including real property actions, title disputes, easements, enforcement of contracts, the dissolution of businesses, corporate disputes, civil rights and employment discrimination.

Before joining the firm Ted practiced law on the East End of Long Island representing private clients. Prior to that he worked for a combined sixteen years in the office of the Suffolk County Attorney, having served as an Assistant County Attorney, Bureau Chief of the General Litigation Bureau and finally as Deputy Suffolk County Attorney.
